Work and study

A fresh look @ applying PGWP in 2021

Post Graduate Work Permit (PGWP)

Once in a Lifetime opportunity for international students; that also means you cannot apply it again, if even you study again.

Applying by yourself ?

One has to be very careful in detailing PGWP application, as it coincides with future immigration goals, and provides a pathway to students for acquiring Canadian Permanent Residency (PR) under multiple immigration programs.

In general, a degree, diploma or certificate of 8 months or longer from an eligible Designated Learning Institute (DLI) is a must.  A student should have actively and successfully pursued their full-time course or program of study. Part-time study during the last seamster of your study will still make you eligible, but may not be considered towards the total duration of your studies for calculating PGWP duration. In case of any discrepancy, you cannot apply PGWP for 6 months after you stopped having unauthorized study or work. So, be accountable and only work for the number of hours allowed as well as study actively.

Applicants have 180 days to apply for PGWP from getting their completion letter or expiration of their Study Permit, whichever is earlier.

Full-time work is official, once applied for PGWP, and if waiting for results.

Let me address some of the key questions:

COVID-19 has 3 major policy amendments that provides full duration eligibility for PGWP, Can you explain it?
  1. If you took an admission in a 8 to 12 months Program that started between May 01, 2020 to September 30, 2020: you can apply for PGWP if even you studied your full program online from outside Canada. (make sure your DLI is PGWP eligible) —– e.g. 12 month program started on June 15, 2020 can have online classes till June 14, 2021 and students outside Canada can apply for 12 month PGWP from their home country;
  2. 50% of your program of study can be done online from any part of the world, till April 30, 2021 and the remaining 50% of studies should be in Canada (before or after online studies) to be eligible to apply for PGWP that can grant 3 years PGWP. —– e.g. 2 years program started on January 15, 2020 can have maximum 1 year online study from any part of the world (to be completed before April 30, 2021) and remaining should be offline within Canada;
  3. 50% of your program of study that started between May 01, 2020 to September 30, 2020 can be done online from any part of the world, till April 30, 2021 and the remaining 50% of total studies should be in Canada (before or after online studies) to be eligible to apply for PGWP that can grant 3 years PGWP in case of combining 2 programs. —– e.g. 1 year program started on May 01, 2020 can have maximum up to April 30, 2021 to study online (full program in this case, but could be less if it started in June, July, August or September) and can be clubbed with another 1 year offline program.
I am facing delays in getting results of my PGWP application due to COVID-19, What could be the consequences?

The processing time is advised by the Canadian immigration to keep an estimate. However, everyone is affected by the pandemic and Canadian immigration system is no different.

Applicant should be mindful with their status in Canada and maintain it. That you are allowed to work during your PGWP is in process, do not worry !

Would I be eligible for a PGWP if I study from any college or institution in Canada? Which are the eligible DLIs?

No,

Your educational institution should be an eligible DLI. One of the easiest way to check them is by verifying the name and corresponding details of your institute by clicking here. If it does not appears in this search, it is not eligible.

It should be a public (Government) post-secondary institute in Canada such as a college, a trade or technical school, a university or CEGEP (in Quebec).

Programs from private institutions in Canada are also eligible if they lead to Bachelors or Masters Degree that are approved by the province. Similarly, Diploma and vocational training programs by private institutes in Quebec only are eligible, if they are of 900 hours or more that lead to Diploma of vocational studies (DVS) or Attestation of vocational specialization (AVS); known as Diplôme d’études professionnelles (DEP), attestation de spécialisation professionnelle (ASP), Diplôme d’études collégiales (DEC) or Attestation d’études collégiales (AEC).

I received scholarship to study in Canada, am I eligible for PGWP?

Yes,

Unless you fall into a specific category of ineligible candidates.

Who are NOT eligible for PGWP?

You are ineligible for PGWP if you:

  • have previously been issued a post-graduation work permit
  • received funding from Global Affairs Canada (GAC)
  • participated in the Government of Canada Awards Program funded by GAC
  • obtained the Equal Opportunity Scholarship, Canada–Chile
  • participated in the Canada–China Scholars’ Exchange Program
  • participated in the Organization of American States Fellowships Program
  • completed the majority of the credits toward the completion of program of study by distance learning
  • completed a program of study delivered by a non-Canadian institution located in Canada, regardless of their length of stay in Canada
  • breached a study permit conditions

Minimum documents required to apply for PGWP are?
  1. Valid Passport
  2. Valid Study Permit and TRV or eTA or immigration Status
  3. Completion letter from the educational institution
  4. Transcript (online from educational institution website is acceptable)
  5. Recent Bank Statement
Will I surely get 3 years of PGWP after my studies?

No,

  1. 3 years PGWP: may be granted for 2 years or longer program of study i.e. 1800 hrs or more of a Vocational program.
  2. Equals to the duration of study: may be granted for more than 8 months and less than 2 years of program of study i.e. 900 hrs or more of a Vocational program.

Multiple programs and different level of studies can be combined to be eligible for PGWP, provided all the studies are successfully completed or credit transferred within Canada from PGWP eligible DLIs.

Can I apply for PGWP at the Canadian Border / Port of Entry (Land Boarder or Airport) ?

You must be TRV-exempt (if you are traveling to the USA only and back with a valid Study or Work Permit, you are TRV-exempt) or a national that do not require a TRV.

Canada/USA Land border or international airport are within their full rights to allow Flagpoling. However, many officers may not be aware of the TRV-exemption and could lead to a bigger issue. You are advised to consult us before any such move.

I have applied for PGWP, can I work full-time ?

Yes,

You are officially allowed to work for any employer on a full-time basis if you have already applied for a PGWP while waiting for the results.

My passport expires before the eligibility of my PGWP duration, what to do?

You should renew your passport in advance, if it permits.

If you have applied or acquired PGWP for the duration up to the expiry of your existing passport, which is shorter than your eligible duration of PGWP, do not worry. You can apply with a paper application to extend your PGWP after getting a new passport and before your original PGWP expires.

Can I travel outside Canada, while waiting for PGWP results or after receiving PGWP?

In both cases you need a valid TRV or eTA to re-enter Canada. Outside Canada PGWP applications are issued TRV along with PGWP and Inside Canada PGWP applicants have to submit a separate TRV application if they wish to travel outside Canada.

TRVs are issued only for the length of the applicant’s current immigration status or travel document/passport validity, whichever has the earlier expiry date.
